"BelPostel" to defend their rights in the court.

Limited Liability Company "DON COTTON", being the owner of the exclusive rights to the trademark "BelPostel" on the basis of a license agreement with the company "Linsten Trading Limited" (British Virgin Islands), has initiated a claim to the owners, not legally use the trademark "BelPostel" in their activities.

During the inspection of more than 50 outlets and websites to sell its products was detected (bed linen), with not a legitimate use of the trademark "BelPostel" without permission.

Than it threatens violators
          According art.1515 of the Civil Code of the Russian Federation, the right holder of a trademark has the right to claim compensation equivalent to twice the value of the goods on which the illegally placed trademark, or twice the amount of the right to use the trademark.
In addition, according to art.180 the Criminal Code of the Russian Federation:
1. Illegal use of a trademark, if the act is committed repeatedly or caused major damage, may be punished by imprisonment for a term not exceeding two years with the payment of fines
2. Illegal use of the label warning against is not registered in the Russian Federation of a trademark or appellation of origin, if the act is committed repeatedly or caused major damage, threatening correctional labor for up to one year.
3. Acts stipulated by the first or second paragraph of this article, committed by a group of persons by prior agreement or an organized group, shall be punished by imprisonment for up to six years with the payment of fines;
Note. Major damage in this article recognizes the damage, the amount of which exceeds two hundred and fifty thousand rubles.

In the case of the need for further use in the activity of the trademark "BelPostel" all violators will be invited to conclude a license contract that will ensure fair use of the trademark "BelPostel".

For all the revealed facts of illegal use of a trademark  will be sent applications to the Interior Ministry, Rospotrebnadzor  and the Federal Antimonopoly Service.
